Does the EU AI Act apply to my company if we're not in the EU?

Yes, if your AI system or its outputs are used in the EU. A US SaaS with EU users, or a content site read in the EU, is in scope. Establishment location doesn't matter — market reach does.

Wasn't the AI Act postponed?

Only partly. The 2025-2026 'Omnibus' changes postponed obligations for high-risk systems (Annex III moved to December 2027). The Article 50 transparency obligations were NOT postponed — they apply from 2 August 2026.

What happens if we don't comply?

Article 99(4)(g) sets fines up to €15,000,000 or 3% of total worldwide annual turnover, whichever is higher. Market surveillance authorities can also order systems off the EU market.

We just use OpenAI / Anthropic / Google models. Are we still a 'provider'?

Usually yes, for your own product: if you offer an AI feature under your own name (an AI chat, a 'generate' button), you're placing an AI system on the market and carry provider transparency duties for it.
